Calvin Klein and Tommy Hilfiger Trademark Infringement Action 2025

Plaintiffs Calvin Klein and Tommy Hilfiger are suing e-commerce sellers in federal court! These major retailers are going forward with this lawsuit because of trademark infringement. The Plaintiffs alleged that a group of online sellers acted as a network to streamline counterfeit sales. What’s more, the latest Calvin Klein and Tommy Hilfiger infringement action is a Schedule A lawsuit. In essence, the “network” of sellers who’ve sold unauthorized products are being sued as a whole. The allegations apply to one and all, though each seller’s outcome and/resolution may be specific to each Defendant.

Where did the trademark infringement on Calvin Klein and Tommy Hilfiger goods occur? On online seller platforms the likes of Amazon, eBay, TikTok, Etsy, Walmart, Temu, DHgate, Wish.com, and more. The Plaintiffs’ allegations are to be taken quite seriously because they will have an effect on the Defendants’ e-commerce business. The most unavoidably disruptive part of this lawsuit will likely be the temporary restraining order that comes with it. Calvin Klein and Tommy Hilfiger will have the court issue a restraining order to block sellers from further infringing sales. Stockman & Poropat, PLLC can help you address this lawsuit, negotiate with the Plaintiffs, and obtain a resolution that ultimately saves you time and money!

What Are the Trademark Infringement Allegations?

The following selections of text represent a cross-section of the trademark allegations filed by the Plaintiffs. We are sharing these excerpts to give readers some context for this legal scenario. If you’re one of the Defendants, be sure to absorb all of the information in the legal complaint, which you can download at the end of this article:

Plaintiffs have identified numerous fully interactive e- commerce stores offering Counterfeit Products on online marketplace platforms such as Amazon, eBay, AliExpress, Alibaba, Walmart, Wish.com, Etsy, DHgate, TikTok, and Temu, including the e-commerce stores operating under the Seller Aliases.

The injuries and damages sustained by Plaintiffs have been directly and approximately caused by Defendants’ wrongful reproduction, use, advertisement, promotion, offering to sell, and sale of Counterfeit Products.

Defendants also deceive unknowing consumers by using Plaintiffs’ Trademarks without authorization within the content, text, and/or meta tags of their e-commerce stores to attract various search engines crawling the Internet looking for websites relevant to consumer searches for Plaintiffs’ Products. Other e-commerce stores operating under Seller Aliases omit using Plaintiffs’ Trademarks in the item title to evade enforcement efforts while using strategic item titles and descriptions that will trigger their listings when consumers are searching for Plaintiffs’ Products.

Counterfeiters such as Defendants typically operate under multiple seller aliases and payment accounts so that they can continue operation in spite of Plaintiffs’ enforcement. E- commerce store operators like Defendants maintain off-shore bank accounts and regularly move funds from their financial accounts to off-shore accounts outside the jurisdiction of this Court to avoid payment of any monetary judgment awarded to Plaintiffs.

Our Attorneys Can Help Save Your E-Commerce Business

Stockman & Poropat, PLLC is a law firm spearheaded by incredible attorneys who possess an incredible amount of experience in e-commerce. Our team is genuinely excited to work with you to figure out the most sensible solution for your business! The cost of retaining an intellectual property attorney is worthwhile because you’ll be able to more effectively protect your business. Sellers in Schedule A lawsuits who try to directly settle with Plaintiffs can end up losing a substantial percentage of their funds.

Calvin Klein and Tommy Hilfiger will have the court approve of a temporary restraining order, as we mentioned. The injunction’s impact will be seen by way of a freeze on the Defendants’ online seller accounts. This restraining order will prevent sellers from accessing any and all money in those accounts! For this reason, our team wants to emphasize that the decision to work with a lawyer or not should be weighed carefully. Direct settlements with Plaintiffs often result in sellers getting to walk away with around 60% of their frozen money. At the very least, consult with our firm to get an idea of the options available to you! We don’t want to see any seller impacted by the lawsuit unnecessarily lose money.

Calvin Klein and Tommy Hilfiger Sues Sellers For Counterfeiting

Basically, Calvin Klein and Tommy Hilfiger’s lawsuit against sellers for trademark infringement is meant to stop unauthorized sales of their products. The mere fact that you sold goods branded with these names could explain why you’ve been named in the lawsuit. Each of the Defendant’s particular involvement in the alleged activity varies. That’s why you’ll benefit from having our lawyers at Stockman & Poropat, PLLC tailor-make you a legal strategy. Calvin Klein and Tommy Hilfiger are attempting to protect their business in a legal context and you can do the exact same thing! Having an IP attorney on your side will provide you, as a seller, with the resources your business requires to continue operating despite the lawsuit.

Please, take this lawsuit seriously! This is a federal trademark infringement action filed by two major brands. Any Defendant in the case must provide a response to the court to avoid a Default Judgment. Dealing with a Default Judgment is typically more costly for Defendants than a restraining order. Respond to the lawsuit, consult with an attorney, develop a strategy, and move forward and onward to further success!
