Harry Styles Trademark Lawsuit

Jun 8, 2023

The exclusive licensee for Harry Styles branded tour merchandise in the US is suing several e-commerce businesses. Perhaps you are one of the Defendants in case No. 23-cv-02718, filed by Greer, Burns & Crain, Ltd.

Harry Styles Trademark Lawsuit. The immediate effect of the lawsuit filed against you and the other named Defendants is the implementation of a Temporary Restraining Order (TRO). To be sure, a TRO against your online account(s) can be extremely frustrating. It may not only impact Harry Styles branded tour goods, but also other entirely unrelated products. To clarify, we wish to emphasize that the TRO is more of a roadblock than a dead end. In other words, you may not necessarily be absorbing a total loss.

Primarily, you should without question RESPOND TO THE LAWSUIT. In the event that you do not respond, the court may issue a Default Judgment. Which is basically equivalent to an admission of guilt. Ignoring the notice will not make the lawsuit magically disappear.

How do I compose a response and what language should go into it? Our team is ready to assist you with those exact details.

Trademark Infringement: Case No. 23-cv-02718

Harry Styles Merchandise Trademark Infringement.

Not unlike many other similar trademark cases, the lawsuit is trying to prove that you are part of a “counterfeit network” that strategically “conceal their identities and the full scope of their operation [to] make it virtually impossible for Plaintiff to learn Defendants’ true identities.” By selling Harry Styles branded products on Amazon, Alibaba, eBay, Walmart, DHgate, Wish.com, and/or AliExpress you are allegedly violating the protected trademark.

Part of the issue, says the notice, is that the e-commerce platforms you utilize apparently “do not adequately subject new sellers to verification and confirmation of their identities, allowing counterfeiters to ‘routinely use false or inaccurate names and addresses when registering with these e-commerce platforms.’”

In like manner, blame is placed on the platforms because they “create bureaucratic or technical hurdles in helping brand owners to locate or identify sources of counterfeits and counterfeiters.”

Another aspect of the lawsuit is the claim that you design your e-commerce stores in an exact way to appear as an “authorized retailer,” even though you are not. “By using the HARRY STYLES Trademarks without authorization,” you are allegedly manipulating search engine optimization and consumers “to evade enforcement efforts.”

In the same way, according to the Plaintiff, you discuss various unlawful “tactics” with the supposed counterfeiting network on sellerdefense.cn, QQ.com, kuajingvs.com, and kaidianyo.com. In combination with these actions, the lawsuit states you are taking advantage of “off-shore accounts outside the jurisdiction of this Court to avoid payment of any monetary judgment awarded to Plaintiff.”

Alright, whew. Let’s take a beat. The accusations made against you and the other Defendants may be confusing. It is possible that you do not fully grasp the full meaning of the allegations. After consideration and review of the notice, try to process the information and remain as calm as possible.

The validity of that which has been laid out in the complaint remains to be proven. Are the statements true? Do they apply to your e-commerce business operations? You have not been determined as guilty. We can assist with sifting through the various statements made by the trademark holder. By doing so, and by talking with you about the particulars related to what products you sell, we will figure out the best method to move forward.
