Rubik’s Cube E-Commerce Trademark Lawsuit. As an e-commerce seller on Amazon, AliExpress, Wish.com. Walmart, eBay, Etsy, DHgate, and other platforms, you may have sold Rubik’s Cube products. The Rubik’s Cube is considered the most popular puzzle toy on the market and is a household name. What’s more, while this toy is widely recognizable around the world, the trademark rights belong to Spin Master, Ltd. and Spin Master Toys UK Limited.

Spin Master has had the rights to the Rubik’s Cube trademarks since 2021. Just this year, Spin Master has filed a lawsuit against online sellers. They are claiming several e-commerce operators have acted unlawfully by infringing on various Rubik’s Cube trademarks, and by extension, offering counterfeit goods to consumers in the United States. 

The Case is No. 23-cv-02758, filed by Greer, Burns & Crain, Ltd. on Spin Master’s behalf in an effort to protect the Rubik’s Cube trademark. 

Rubik’s Cube Trademark Lawsuit

  1. Spin Master, owner of the trademark in question, has sustained financial damages as a result of you selling Rubik’s Cube products. 
  1. You have knowingly sold, “offered to sell, marketed, distributed, and advertised” counterfeit versions of Rubik’s Cube goods. 
  1. You are part of a systematic counterfeiting network of e-commerce business operators who discuss how to most successfully continue selling infringing Rubik’s Cube puzzle toys. 
  1. You use off-shore bank accounts to move money outside the enforceable zone of the court in which the lawsuit was filed. By doing this, you are trying to “avoid payment of any monetary judgment awarded to Spin Master.” 
  1. You have discussed counterfeiting tactics individually or in concert with other sellers on QQ.com, sellerdefense.cn, kaidianyo.com, and kuajingvs.com. 

Accused of Infringement for Selling Rubik’s Cubes? 

Furthermore, another principal claim is that you have developed one or more methods of disguising your true business identity on e-commerce platforms. The lawsuit describes this action as deceptive. Spin Master wants to prove that you are not an authorized retailer of Rubik’s Cube toys. You have also been accused of developing methods of operation online from “China or other foreign jurisdictions with lax trademark enforcement systems” that maneuver around the laws in place designed to protect trademarks.
