Sellers Sued by Crye Precision For Counterfeiting

Crye Precision is seeking a temporary restraining order against online sellers! This trademark infringement lawsuit was filed in federal court to curb an alleged network of counterfeiting. We don’t want any named seller in this lawsuit to lose all of their money! To that end, Defendants need to respond to the Crye Precision lawsuit in a timely manner. Choosing to ignore the lawsuit could potentially cost you even more money. See, once the TRO is in play, your seller account or accounts will be frozen. Defendants also deceive unknowing consumers by using the CRYE PRECISION Trademarks without authorization within the content, text, and/or meta tags of their e-commerce stores to attract various search engines crawling the Internet looking for websites relevant to consumer searches for Crye Precision Products. Other e-commerce stores operating under the Seller Aliases omit using CRYE PRECISION Trademarks in the item title to evade enforcement efforts, while using strategic item titles and descriptions that will trigger their listings when consumers are searching for Crye Precision Products.

Counterfeiters such as Defendants typically operate under multiple seller aliases and payment accounts so that they can continue operation in spite of Plaintiff’s enforcement. E- commerce store operators like Defendants maintain off-shore accounts and regularly move funds from their financial accounts to off-shore accounts outside the jurisdiction of this Court to avoid payment of any monetary judgment awarded to Plaintiff. 

Defendants’ unauthorized use of the CRYE PRECISION Trademarks in connection with the advertising, distribution, offering for sale, and sale of Counterfeit Products, including the sale of Counterfeit Products into the United States, including Illinois, is likely to cause and has caused confusion, mistake, and deception by and among consumers and is irreparably harming Plaintiff. 

Crye Precision Federal Lawsuit

Crye Precision’s federal trademark lawsuit is aimed at online sellers who the Plaintiff believes engaged in counterfeiting. The allegations are somewhat wide-ranging in terms of the conduct described as unlawful by the Plaintiff, as seen above. Are the allegations applicable to the actions of every single online seller listed on the lawsuit’s Schedule A? In all probability, the claims made by Crye Precision may not even apply to everyone named.
