Eagles Trademark Infringement Lawsuit | Online Sellers Sued

The owner of the intellectual property of the famous rock band the Eagles has filed a trademark lawsuit! Sellers have been accused of selling unauthorized versions of Eagles products. The Plaintiff alleges that the sellers intentionally sold counterfeit goods. That’s not all of the allegations of the trademark lawsuit, either. 

Below, we’ll share a selection of the trademark infringement claims in the newest Eagles lawsuit. These excerpts were taken directly from the legal complaint tied to the lawsuit, which you can download at the end of this article:

E-commerce stores operating under the Seller Aliases often include content and images that make it very difficult for consumers to distinguish such stores from an authorized retailer. Plaintiff has not licensed or authorized Defendants to use any of the EAGLES Trademarks, and none of the Defendants are authorized retailers of genuine Eagles products.

Defendants also deceive unknowing consumers by using the EAGLES Trademarks without authorization within the content, text, and/or meta tags of their e-commerce stores to attract various search engines crawling the Internet looking for e-commerce stores relevant to consumer searches for Eagles products. 

Other e-commerce stores operating under the Seller Aliases omit using the EAGLES Trademarks in the item title to evade enforcement efforts while using strategic item titles and descriptions that will trigger their listings when consumers are searching for Eagles products. 

Being Sued, Respond to the Lawsuit!

E-commerce operators being sued by the Eagles need to respond to the lawsuit! Do you want to have to contend with a Default Judgment? We wouldn’t recommend you do! And, the most effective method for avoiding a Default Judgment is to respond. There’s hardly any sensible reason for choosing not to respond. Sellers could risk losing money and stripping themselves of the ability to overturn any sort of decision. The Eagles lawsuit is legitimate and must be addressed. Even if the allegations don’t precisely pertain to your business practices, you’ll need to respond. 

The owner of the Eagles intellectual property decided to sue multiple online sellers because of counterfeiting. At least, counterfeiting and trademark infringement were observed and documented by the Plaintiff. Based on the Eagles’ information, the actions of the sellers were unlawful and resulted in damage to the brand name. Amazon, eBay, AliExpress, Alibaba, Wish.com, Etsy, Walmart, Temu, DHgate, and TikTok are the platforms where these goods were sold. Have you used any of the aforementioned marketplaces to sell Eagles branded goods? That may explain why the Plaintiff is suing you and your e-commerce business. Whether accurate to your business or not, the allegations will impose a disruption. 

The Unmistakable Form of the Temporary Restraining Order

That disruption will take the unmistakable form of a temporary restraining order. Have you ever heard of a temporary restraining order before? The TRO will be an injunction approved by the court that applies a freeze to the Defendants’ online seller accounts. With that freeze in place, sellers won’t be able to access the money in their accounts. Now, the restraining order will impact earnings made by way of the sale of Eagles products. It’s also possible that the injunction will affect money generated from the sale of other goods. All in all, the TRO is a true roadblock in the path of an online seller. The rest of your hard-earned funds will be awarded to the Eagles. Remember when we mentioned Default Judgments? Same thing – sellers who don’t respond will see all of their money given to the Plaintiff.
