Consider your legal team and place Stockman & Poropat, PLLC at the top of your list!

So yes, this is a matter that requires serious consideration by the Defendants. Part of the concern when it comes to these counterfeit lawsuits is disruption. Also, the potential for loss of revenue. No one wants to likely hear that a lawsuit will result in them losing money, but it’s a very real possibility. That’s why having a superb intellectual property attorney is so darn important! Stockman & Poropat, PLLC is proud to relay that our firm is led by a team of award-winning attorneys. We’ve developed effective legal solutions for e-commerce sellers all around the world!

What Sellers Being Sued in the Dior Counterfeit Lawsuit Can Expect

The Plaintiff will have the court approve of a temporary restraining order. This is also known as a TRO or injunction. When the injunction is in place, named e-commerce operators will see their marketplace accounts frozen. This means that the funds in those accounts, across marketplaces, will be frozen, as well. Therefore, the funds will be inaccessible! You’ll be blocked from accessing your hard-earned money, at the end of the day. This can be significantly disruptive and even shove some sellers close to the edge of bankruptcy. Rather than wallow in the gravity of the situation or feel as though you’re helpless, contact Stockman & Poropat, PLLC today!

As you’ve likely gathered by this point, the Dior trademark infringement action is not a matter to be taken lightly. A restraining order that prevents sellers from accessing their money… There’s no way to NOT see how this will affect your business. Bottom line, e-commerce operators need money to operate! At Stockman & Poropat, PLLC, we’ll do everything we can to save you both money and time.

Christian Dior’s Latest Trademark Infringement Lawsuit Disrupts E-Commerce Sellers

There are not only risks associated with the lawsuit concerning the restraining order. If any affected seller doesn’t respond to the court they can very possibly get struck with a Default Judgment. When a DJ is issued by the court, the repercussions can be expensive for sellers. For example, if you fail to respond to the lawsuit for any reason, the court might award the entirety of your frozen marketplace assets to the Plaintiff! These determinations are often permanent, as well. Overturning a Default Judgment is usually not an option.

So, if you’re not interested in handing over a substantial amount of money that you and your business earned, it’s worth aligning with the appropriate intellectual property law firm. Stockman & Poropat, PLLC is prepared to work with e-commerce operators from the beginning stages all the way to resolution. Our firm prides itself on ensuring clients are well taken care of and informed with streamlined communication.

Within the legal complaint tied to the Dior infringement action, you’ll see that the Plaintiff has specific a variety of counterfeit allegations. These allegations range from using specific online metadata tactics, to relying on the use of off-shore bank accounts, to communicating with other sellers to more effectively push counterfeit goods. The most impactful allegation is the one that describes the collective Defendants as a counterfeit network. By claiming as much, Dior is attempting to establish that the sellers work together, as a unit, to offer infringing goods to consumers. It’s up to each Defendant to work with an attorney to determine whether or not these various allegations are applicable to their e-commerce operation. And from there, Stockman & Poropat, PLLC will create an effective legal strategy!

Dior Claims Sellers Caused Collective Harm by Selling Counterfeit Products

Here are several excerpts from the legal complaint to paint a fuller picture of Dior’s allegations:

Defendants also deceive unknowing consumers by using the CHRISTIAN DIOR Trademarks without authorization within the content, text, and/or meta tags of their e- commerce stores to attract various search engines crawling the Internet looking for websites relevant to consumer searches for Dior Products. Other e-commerce stores operating under the Seller Aliases omit using CHRISTIAN DIOR Trademarks in the item title to evade enforcement efforts while using strategic item titles and descriptions that will trigger their listings when consumers are searching for Dior Products.

Defendants are collectively causing harm to Dior’s goodwill and reputation because the effect of their unlawful actions taken together amplifies each harm and creates a single negative consumer impression. Defendants’ activities, occurring at the same time and in the same retail space and manner as one another, blend together to create a single negative impression on consumers such that they constitute the same occurrence or series of occurrences.

The combination of all Defendants engaging in the same illegal activity in the same time span causes a collective harm to Dior in a way that individual actions, occurring alone, might not.
