E-Commerce Sellers Sued | BBC Studios Lawsuit Over the Sale of Bluey Goods

BBC Studios Distribution is once again gunning for online sellers over allegations of trademark infringement. The company claims that a grouping of e-commerce operators have sold Bluey branded products without authorization. Thus, the Plaintiff has alleged that the sale of these products amounts to counterfeiting. And, as a result of these actions, BBC Studios has taken a financial hit and their reputation has been damaged. Let’s get into the latest Bluey trademark lawsuit.

If you’ve been notified that you’re one of the Defendants in this BBC Studios lawsuit over the sale of Bluey goods, you may want to work with our team at Stockman & Poropat, PLLC! This is an absolutely serious matter that will affect your online business and sales. Please don’t make the mistake of ignoring the Bluey lawsuit or assuming it will be settled without your participation. That’s not going to be the way it develops! As a Defendant, you’ll need to take certain steps to avoid even further penalties. For example, you could face a Default Judgment. If that is the outcome for any seller, the decision is typically set in stone and comes at a high cost. Rather than complicate things unnecessarily, reach out to our firm!

At Stockman & Poropat, PLLC, we utilize our longstanding experience in the e-commerce space to advocate for online sellers just like you. If you’re an online seller and have a legal issue, we’re the firm that can deliver a legal solution that creatively addresses all of your ambitions and needs. It’s our creativity that sets us apart! Not to mention, we’ve handled trademark infringement cases for numerous sellers based in every part of the world. We’re pleased to say that we’ve also been awarded for our extraordinary work as attorneys.

Why You Should Work With Us at Stockman & Poropat, PLLC

Why should you work with us at Stockman & Poropat, PLLC? Because we care about online sellers and the issues they face when it comes to infringement allegations! And, we prioritize a client-forward approach, wherein you can communicate with us as needed in a streamlined fashion. We like to keep our clients in the loop throughout their entire legal journey and we’re not afraid to laugh, either! Actually, friendliness and warmth are some of our unique, key character traits at the firm, because we want you to feel comfortable and informed all along the way. Your e-commerce operation is incredibly important to you and we want to protect that at all costs!

Due to the filing of this Bluey lawsuit, the Defendants will have to address certain roadblocks. The main and most disruptive is going to be the temporary restraining order. This injunction is often relied on by brands suing sellers as it halts further sales of so-called counterfeit goods, for a limited time. Why is BBC Studios interested in getting a restraining order approved for this particular lawsuit? Well, as in many other similar cases, the Plaintiff alleges that they’ve lost revenue due to the sellers’ actions. They claim that the sale of unauthorized Bluey products has caused confusion among consumers and misrepresented the Bluey brand. Whether accurate or inaccurate, the injunction will disrupt your operation.

BBC Studios Will Freeze Your Online Seller Accounts | BBC Studios Lawsuit Over the Sale of Bluey Goods

By freezing your online seller accounts, the temporary restraining order will render your funds inaccessible. That’s correct, the BBC Studios trademark lawsuit over Bluey products will result in your money being frozen in your accounts. See, the Plaintiff doesn’t want any more counterfeit Bluey goods being offered on the marketplace. So they’re going to stifle the earnings of all suspected sellers who’ve sold these unauthorized products to consumers. It’s no small thing, as sellers should know, when you’re prevented from accessing much needed funds.

Beware of the Pitfalls of Direct Settlement Negotiations | Bluey Trademark Lawsuit

And sure, e-commerce operators are not required to work with Stockman & Poropat, PLLC, or any other law firm for that matter. But, it will overwhelmingly benefit sellers to do so, particularly with our firm! The thing is, sellers who attempt to negotiate direct settlements with Plaintiffs like BBC Studios often don’t get the best outcome. By that we mean, sellers average out at around 60% with this approach, leaving the remaining balance to the Plaintiff. Are you in a position to take a 40% loss of earnings just because you want to settle directly? Most sellers aren’t, as that substantial loss may even put them out of commission. Stockman & Poropat, PLLC can get you the sort of resolution that makes sense and is tenable!

To provide sellers with more details regarding the BBC Studios trademark lawsuit, we’ll turn to the legal complaint. You may download the complaint at the end of this article, if you so wish. By taking a look at these excerpts, one may gain a better grasp of the allegations and what’s at stake. Overall, consider that BBC Studios is taking legal action, and on the flip side, it really only makes sense that sellers do, too…
