Hyundai Claims Trademark Infringement, Sues Sellers For Counterfeiting

Sellers Sued For Allegedly Pushing Counterfeit Hyundai Goods Across Online Marketplaces

Want to know just what’s in store and at stake with the latest trademark infringement lawsuit filed by Hyundai? The Plaintiff has moved forward with the counterfeit action for multiple reasons, all of which are detailed in the legal complaint. Let’s take a gander at some of the allegations below:

[Sellers] also deceive unknowing consumers by using one or more Hyundai Trademarks without authorization within the content, text, and/or meta-tags of their e- commerce stores to attract various search engines crawling the Internet looking for websites relevant to consumer searches for Hyundai Products.

Defendants are collectively causing harm to Hyundai’s goodwill and reputation because the effect of their unlawful actions taken together amplifies each harm and creates a single negative consumer impression. Defendants’ activities, occurring at the same time and in the same retail space and manner as one another, blend together to create a single negative impression on consumers such that they constitute the same occurrence or series of occurrences.

The combination of all Defendants engaging in the same illegal activity in the same time span causes a collective harm to Hyundai in a way that individual actions, occurring alone, might not.

Stockman & Poropat, PLLC is the Intellectual Property Law Firm You Can Trust

Are you a named Defendant in this Hyundai infringement lawsuit? Are you considering taking on the burden of figuring out a resolution on your own? Any affected online seller in this action is entitled to try and pursue a direct settlement, for sure. It may not be the most effective means to the solution you’re seeking, though. In the majority of instances, Defendants who attempt to settle directly with brands like Hyundai don’t get what they deserve. You’re also risking having a significant amount of your hard-earned funds awarded to the Plaintiff. Rather than trying to shoulder the full weight on your own, rely on our incredible team at Stockman & Poropat, PLLC!

The latest Hyundai lawsuit is a serious matter! Any named seller in the lawsuit should act accordingly and know that they have the right to their own legal representation. Stockman & Poropat, PLLC is a pre-eminent intellectual property law firm that has helped sellers all around the world. Our team knows the ins-and-outs of e-commerce, from the granular to the macro level, and we’re always thrilled to create an effective legal strategy!

It shouldn’t be difficult to comprehend how serious the Hyundai trademark action is for the impacted sellers. The finances of each Defendant are vulnerable due to the filing of the lawsuit. You’ll want to protect your assets as much as possible and you can do so by aligning with a stellar legal team. It’s important to stay informed about the details of the case and the allegations being put forward by Hyundai, too. As noted at the top of this article, Hyundai has cited several alleged actions that the Defendants engaged in. These allegations rather span a wide range, in terms of so-called “unlawful activity.”

Hyundai Alleges Defendants Acted Unlawfully as a Counterfeit Network

The allegation concerning what the Plaintiff calls a “counterfeit network” is likely the most relevant. By describing the named sellers’ actions as collective, Hyundai has given itself the ability to file this lawsuit. The suit’s “Schedule A,” containing a list of the Defendants, who supposedly collaborated to sell counterfeit goods, represents this allegation. Hyundai intends to try and prove that the sellers worked together. And, because they worked together, they collectively caused more damage than if they acted alone. Again, these are just allegations and nothing has yet been proven. Even so, the lawsuit’s impact will be felt by the Defendants and each will benefit from working with an IP attorney.

Hyundai is trying to protect the value of their brand and its intellectual property by filing this lawsuit. To achieve that end, the Plaintiff will seek and get approval for a temporary restraining order. The purpose of the restraining order is to put an immediate stop to the sale of counterfeit Hyundai products. The injunction will freeze all money in online seller marketplace accounts, for a temporary period of time. If you’ve sold goods on Amazon, Walmart, Wish.com, Temu, etc., all of the accounts will be affected. The amount of money in those accounts and/or the overall health of any given e-commerce business will determine how severely this will disrupt the sellers’ operations. It’s reasonable to expect that it will be severe enough to grab the Defendants’ attention. And, spur them into taking their own legal action!

Stockman & Poropat, PLLC Wants Your E-Commerce Operation to Thrive

Stockman & Poropat, PLLC wants your e-commerce operation to thrive! Our goal is always to diminish any stress and save our clients as much time and money as possible. By utilizing our extraordinary level of experience in the e-commerce space, we’ll develop a legal strategy that actually works! A lack of action in this instance could be harmful to your business, both now and over the long term.

It’s crucial that sellers provide a response to the court in a timely fashion. This will preclude the Defendant from receiving a Default Judgment. It’s very probable that none of the named sellers would wish for a DJ, as it’s costly. Further, it’s extremely difficult to overturn Default Judgment decisions. Instead of hoping the lawsuit wasn’t filed or believing the issue will be resolved on its own, be sure to respond!

Stockman & Poropat, PLLC knows what it takes to properly address and navigate an intellectual property infringement lawsuit. Our team prides itself on interacting with our clients using open and honest communications. We want you to know exactly what’s going on and if you have questions or concerns we want to know about them! Getting named in the latest Hyundai trademark infringement action can be stressful. Our firm is here to reduce your anxiety and develop a strategic plan.
