Barbie Trademark Infringment Lawsuit

Don’t ignore the latest Mattel trademark infringement lawsuit! Has your e-commerce business been named in the federal trademark action filed by Mattel? If that’s the case, you must take this matter seriously and respond accordingly. Although not all of the allegations will be applicable to each of the sellers to the same degree, all of the Defendants need to respond.

Even though the allegations of counterfeiting are described as unlawful, the claims themselves don’t equate to guilt. A failure to respond could be interpreted by the court as an admission of guilt, which will make the situation more complicated! You don’t want to have to contend with a Default Judgment! To save yourself both time and money, work with our attorneys at Stockman & Poropat, PLLC.

Mattel Sues Sellers For Unlawful Sale of Barbie Products

Mattel is suing online sellers for a multitude of reasons, all described in the legal complaint. The allegations of intellectual property infringement are based on the Plaintiff’s claims. The basis of the allegations? A network of e-commerce sellers, based in different locations, communicate with each other to more successfully sell unauthorized Barbie products to consumers. Furthermore, Mattel alleges that the Defendants utilize specific strategies for evading enforcement. The Plaintiff says that sellers use various digital methods for disguising their true identity, rely on off-shore accounts to stash their money, and more. According to Mattel, the totality of the Defendants’ actions has damaged the brand and resulted in losses. And, so, the Plaintiff is filing the lawsuit to stop what they believe is happening.

As we mentioned, not all of the sellers will be affected by the lawsuit in the same way. Regardless, our team at Stockman & Poropat, PLLC can help you protect your business and your money! These Schedule A infringement lawsuits can definitely disrupt the normal flow of your e-commerce operation. In doing so, the side effect may be frustration, annoyance, or even intimidation. Stockman & Poropat, PLLC will ensure that the emotional component of the situation doesn’t override the legal aspects!

How Will Sellers’ Businesses Be Affected?

What will the lawsuit’s effect look like in terms of the impact? The court will approve a temporary restraining order against the named online sellers. Also referred to as an injunction, the TRO will block sellers from accessing the money in their accounts. In most instances, the restraining order is applied to the funds earned from the sale of a Plaintiff’s products. With Mattel, that’s likely. It’s also a possibility that the injunction will affect money earned from selling other branded goods. It may come as no surprise, but Mattel’s intention with the account freeze is to put a stop to counterfeit sales. Again, even if you’re not entirely implicated in the allegations, you still have to respond and figure out a resolution!

With Schedule A infringement lawsuits, Defendants may have an interest in reaching a direct settlement with the Plaintiff. We know that there’s some appeal for this avenue. But the lure of the option is more attractive than the reality. Most Defendants who attempt to reach a settlement with a brand like Mattel, without relying on the aid of an attorney, don’t get a fair resolution. Actually, it’s probable that a seller will walk away from this lawsuit with only 60% of the amount of money in their frozen seller accounts. If they choose to work out a direct settlement. Working with an intellectual property attorney like Stockman & Poropat, PLLC will vastly improve your potential outcome. Our lawyers want to see your e-commerce business thrive. We’ll put our experience to work to get you the resolution you deserve!

The Mattel/Barbie federal lawsuit is aimed at stopping the sale of unauthorized, counterfeit products to consumers in the United States. The entirety of the allegations of trademark infringement are laid out in the legal complaint. Let’s take a look at a selection of Mattel’s claims of counterfeiting:

The success of the Barnie brand has resulted in significant counterfeiting of the BARBIE Trademarks and copying of the Barbie Copyrighted Work. Consequently, Mattel has a worldwide anti-counterfeiting program and regularly investigates suspicious e-commerce stores identified in proactive Internet sweeps and reported by consumers.

In recent years, Mattel has identified many fully interactive, e-commerce stores offering Unauthorized Products on online marketplace platforms such as Amazon, eBay, AliExpress, Alibaba, Walmart, http://Wish.com, Etsy, DHgate, TikTok, and Temu, including the e-commerce stores operating under the Seller Aliases.

Many Defendants also deceive unknowing consumers by using the BARBIE Trademarks without authorization within the content, text, and/or meta tags of their e-commerce stores to attract various search engines crawling the Internet looking for websites relevant to consumer searches for Barbie Products. Other e-commerce stores operating under the Seller Aliases omit using the BARBIE Trademarks in the item title to evade enforcement efforts while using strategic item titles and descriptions that will trigger their listings when consumers are searching for Barbie Products.
