Mob Entertainment Trademark Infringement Action

Poppy Playtime Trademark and Copyright Lawsuit

Mob Entertainment, owner of the Poppy Playtime intellectual property, has filed a lawsuit against online sellers! The IP owner claims that several online sellers put up counterfeit versions of their products for sale online. The alleged sale of trademark and copyright infringing goods were sold across a range of online marketplaces. These marketplaces include Amazon, TikTok, Temu, DHgate, Etsy, Walmart, Alibaba, AliExpress, eBay, and others. Are the allegations made by Mob Entertainment true and accurate? The Defendants’ actual conduct may vary from one seller to another, but nonetheless, you’ll need to respond!

A common subject that arises with trademark infringement lawsuits centers around direct settlements. Online sellers who’ve been notified that a lawsuit is aimed at them often consider this route. Defendants in this case, or another Schedule A lawsuit with similar details, may benefit from knowing that this choice can lead to financial loss! Who would willingly decide to lose money?! Not many and it shouldn’t be any different with this situation. E-commerce sellers in particular require access to their money – a disruption to that access could have serious consequences for sellers. Rather than risking a loss by settling directly with Mob Entertainment, you may want to hire an intellectual property attorney!

Don’t Risk Losing Money

Don’t risk losing money by attempting to solve this issue on your own. Work with our IP attorneys at Stockman & Poropat, PLLC and we’ll use our incomparable level of experience in the field to get the most financially sound outcome available!

As we noted, the Poppy Playtime trademark and copyright infringement lawsuit will likely cause a disturbance for many if not all of the Defendants. How’s that going to manifest? By way of a temporary restraining order that the court will approve. Mob Entertainment seeks to stop any further sales of counterfeit Poppy Playtime products. To achieve that end, the Plaintiff will get the temporary injunction to go into effect. And what occurs after the restraining order is approved? Sellers will be barred from accessing the funds in their accounts. You won’t be able to touch the money in your seller accounts because it’ll be frozen! The TRO freeze will impact money earned from the sale of unauthorized Poppy Playtime goods. In addition, the freeze could also affect money generated from other sales. It’s a significant legal maneuver that all of the named sellers should take seriously!

What caused Mob Entertainment to file a trademark and copyright lawsuit that alleges infringement? The Plaintiff’s claim is that the sellers formed a network of counterfeiters. Per the Plaintiff, this ‘network’ of sellers actively invests time and energy into developing the most effective counterfeit strategies. Alongside that effort, the Defendants allegedly share information so as to ensure their counterfeiting network is strong. And, Mob Entertainment claims, the sellers also rely on off-shore bank accounts to stash their earnings, so they can avoid paying any damages if caught. These statements are not necessarily applicable to each and every Defendant. That’s why working with an attorney is so crucial! Whether you’ve done what Mob Entertainment says you did or not, you need to work out a resolution.

We can’t impress upon sellers enough that responding is essentially a necessity. The Poppy Playtime trademark and copyright lawsuit can potentially upend your e-commerce business. Don’t let Mob Entertainment secure all your money before you even try to protect it! Meaning, those Defendants who don’t respond to the lawsuit may lose all of their hard-earned money. A lack of a response may cause the court to issue a Default Judgment. And, if that happens, the total amount of money in your account (frozen by the TRO) will be awarded to Mob Entertainment. Easily avoid that by responding!

What Applies to Me as an Online Seller?

Not every shred of the allegations will apply to the totality of named sellers. However, all will likely be unfavorably affected by the temporary restraining order. The full outline of the allegations of trademark and copyright infringement can be seen in the legal complaint. To provide more context, below we’ll share a selection of the allegations, so as to present a fuller picture of this Schedule A lawsuit:

In recent years, Plaintiff has identified many fully interactive e-commerce stores offering Unauthorized Poppy Playtime Products on online marketplace platforms such as Amazon, eBay, AliExpress, Alibaba, http://Wish.com, Walmart, Etsy, DHgate, Temu, and TikTok, including the e-commerce stores operating under the Seller Aliases. The Seller Aliases target consumers in this Judicial District and throughout the United States.

Defendants facilitate sales by designing the e-commerce stores operating under the Seller Aliases so that they appear to unknowing consumers to be authorized retailers, outlet stores, or wholesalers. E-commerce stores operating under the Seller Aliases appear sophisticated and accept payment in U.S. dollars and/or funds from U.S. bank accounts via credit cards, Alipay, Amazon Pay, and/or PayPal.

E-commerce stores operating under the Seller Aliases often include content and images that make it very difficult for consumers to distinguish such stores from an authorized retailer. Plaintiff has not licensed or authorized Defendants to use the POPPY PLAYTIME Trademarks or copy or distribute the Poppy Playtime Copyrighted Works, and none of the Defendants are authorized retailers of genuine Poppy Playtime Products.
