Entertainment One UK, LTD. (eOne), which has the registered trademarks and copyrighted designs for Peppa Pig and PJ Masks, has filed a lawsuit. Case No. 23-cv-02820 claims that you and several other online sellers have knowingly offered counterfeit goods to customers in the United States. 

As it stands, eOne is attempting to prove counterfeiting in order to get “monetary relief.” The company is doing so because they believe they have been “irreparably damaged through consumer confusion.”

You may use e-commerce platforms like Amazon, Etsy, DHgate, Walmart, Wish.com, Alibaba, AliExpress, and/or eBay. A key part of the context of the lawsuit hinges on the presumption that these platforms do not verify sellers, like yourself, with enough scrutiny. This claim by eOne is virtually identical to allegations made by many other companies in similar counterfeiting lawsuits. In short, a failure to require seller identification transparency permits sellers to infringe on trademarks and copyrighted designs.

According to eOne, the Defendants rely on off-shore bank accounts to stash money so they cannot be held to the rule of law within the jurisdiction of the US court system. In the event that a ruling was made in favor of eOne, the off-shore bank accounts would allow the Defendants to “avoid payment of any monetary judgment.” 

Another claim is that you regularly speak with other alleged counterfeiters on sites such as QQ.com, sellerdefense.cn, kaidianyo.com, and kuajingvs.com. Your communication in this way lends itself to the theory that you and the Defendants are actively and knowingly selling unauthorized Peppa Pig and PJ Masks products. In addition, you are offering these counterfeit goods as part of a network of illegal activity.  

Lastly, the lawsuit alleges that you have abused the subpar verification and identification requirements on various platforms to sell these infringing Peppa Pig and PJ Masks goods. Per eOne, the Defendants routinely mask their identities and names during the registration process. By doing so, you can allegedly more easily make your e-commerce business appear as an authorized retailer of Peppa Pig and PJ Masks goods, even though you may not be.
