Tottenham Hotspur Limited Trademark Infringement Lawsuit

The professional football club Tottenham Hotspur Limited is suing online sellers due to trademark infringement! The Plaintiff, THFC, has lodged several allegations of intellectual property infringement against sellers. To better understanding what these claims of counterfeit are, let’s examine a few paragraphs from the legal complaint: 

Defendants concurrently employ and benefit from substantially similar advertising and marketing strategies. For example, Defendants facilitate sales by designing the e-commerce stores operating under the Seller Aliases so that they appear to unknowing consumers to be authorized online retailers, outlet stores, or wholesalers. 

E-commerce stores operating under the Seller Aliases appear sophisticated and accept payment in U.S. dollars and/or funds from U.S. bank accounts via credit cards, Alipay, Amazon Pay, and/or PayPal. E-commerce stores operating under the Seller Aliases often include content and images that make it very difficult for consumers to distinguish such stores from an authorized retailer. 

Plaintiff has not licensed or authorized Defendants to use any of the THFC Trademarks, and none of the Defendants are authorized retailers of genuine THFC Products. 

[Sellers] also deceive unknowing consumers by using the THFC Trademarks without authorization within the content, text, and/or meta tags of their e-commerce stores to attract various search engines crawling the Internet looking for websites relevant to consumer searches for THFC Products.  

Your E-Commerce Operation Will Be Impacted by the THFC Lawsuit

Please take this lawsuit very seriously! You’re e-commerce operation will be impacted by the trademark action filed by THFC. You’ll want to provide a response to the court so that you don’t get hit with a Default Judgment. Because this is a federal intellectual property infringement case, a Default Judgment could be very costly. Tottenham Hotspur Limited has filed this lawsuit to put an end to what the Plaintiff believes has been overwhelming sales of counterfeit goods. See, due to the popularity of THFC as a football club, many products are branded with their intellectual property. Among the allegations put forward, THFC claims that the Defendants organized a sort of network. With that network, the online sellers, as a whole, worked with one another to successfully sell unauthorized products. And, these alleged sales occurred across multiple platforms. The online marketplaces where the counterfeit sales were supposedly transacted were Amazon, eBay, AliExpress, Alibaba, Wish.com, Walmart, Etsy, DHgate, TikTok, and Temu. 

Ok, so we mentioned the response and how that can allow sellers to avoid Default Judgments. We touched on some of the THFC allegations, as well. So what about the impact on the Defendants’ e-commerce businesses? The filing of this trademark lawsuit means that THFC will get the court to issue a temporary restraining order. This injunction will directly affect the sellers’ online accounts, in that the money in those accounts will be frozen! 

What To Do When Your Online Accounts Are Frozen

Without a doubt, having the money in your e-commerce account frozen is no small thing. Usually, the restraining orders in these counterfeit lawsuits affects only the money earned from selling the Plaintiff’s products. It’s possible that the injunction will also apply to other money in your seller accounts. 

Sellers may want to look into how they can directly settle with the Plaintiff. We hope the Defendants will consider what a direct settlement could mean for their business. While it may be a fast solution to a major issue, it can be negative long term for your operation. By and large, online sellers being sued for intellectual property infringement only get about 60% of their money with direct settlements.
