In fact, our firm is so passionate, our attorneys have even received awards for their incredible work! The world of online selling is widely recognized as where consumers buy products. Which is simple. But e-commerce is also where those who sell the goods can get ensnared in various issues. Which is a bit more complex! Our team at Stockman & Poropat, PLLC functions to disentangle you and your business from legal complications, like infringement allegations!
Receiving notice that the Liverpool Football Club (LFC) is suing you could make some sellers extremely nervous or fearful. Fear and nerves may be useful responses, at times, but with regard to this latest LFC lawsuit, they are more counterproductive. A minor level of anxiety may be appropriate, as you’ll want to stay motivated to take action in a timely sense. What action is that? Hiring a superb intellectual property law firm! Stockman & Poropat, PLLC is THAT firm.
Online sellers might be curious as to what the lawsuit is going to do? As in, how will the LFC trademark infringement action actually impact the Defendants? This is relatively straightforward. Sellers can expect what is known as a temporary restraining order. This restraining order, also called a TRO and/or injunction, will freeze the Defendants’ seller accounts. The freeze will affect all seller accounts. So if you have an Amazon and Walmart e-commerce account, funds in both accounts will be inaccessible. How are sellers supposed to operate at a normal level when they’re being blocked from the money they themselves earned? That’s a great question! Figuring out a solid path to resolution is crucial so sellers can return to selling ASAP.
LFC Aims to Stop E-Commerce Sellers From Offering Unauthorized Products
LFC has filed this trademark action to combat the sale of counterfeit Liverpool Football branded goods. As a result of the lawsuit, named sellers should expect that their financial health as an e-commerce business may dip. Not necessarily, but that’s always a possibility. As it depends on the amount of money tied up by the temporary restraining order. If you’ve got a marketplace account with $100,000 and the injunction freezes that money, the impact could be very significant to a business, overall. Stockman & Poropat, PLLC is thoroughly prepared to develop a creative, individualized legal strategy for your business, based on your precise needs.
The impact of the restraining order will likely be felt right away. To what extent, exactly, again depends on the amount of money tied up by the injunction. As well as the overall success/financial status of any given e-commerce operation. But don’t take this information as a sign to remain inactive, for any reason. Meaning, it’s not going to be useful to throw one’s hands up in distress or dismay. Be sure to respond to the court, regarding the LFC lawsuit, to avoid a Default Judgment. Those Defendants who for any reason don’t submit a timely response will likely get hit with a DJ. The potential outcome of a DJ could even be all of the frozen funds in your account getting awarded to the Plaintiff!
LFC Identifies “Counterfeit Network,” Sues Defendants in Collective Action
All in all, you should get the sense by now that this isn’t a matter to be taken lightly. Why not? Well, it’s easy to understand if you consider the financial aspect. However, the deeper reason for the seriousness of this action lies within the Plaintiff’s primary infringement allegation. LFC, like many other brands/companies pursuing similar legal action, alleges that the Defendants are a “counterfeit network.” The definition of the phrase is quite simple. LFC believes the named sellers have collaborated in multiple ways to more efficiently sell unauthorized products online.
By communicating with one another to share counterfeiting methods, the Plaintiff claims that the Defendants functioned as a whole. Therefore, LFC is suing the sellers as a group, rather than one by one. It’s this allegation in particular that allows for the type of lawsuit seen here. The allegation that the named sellers are interrelated permits LFC to sue the Defendants, also collectively.
Truly, whether you’ve got a somewhat negligible or a very substantial amount of capital tied up in frozen accounts, you’ll likely want to consider legal action. Reaching out to the Plaintiff on your own is also an option, but sellers who choose this route often end up losing a major percentage of their earnings. Direct settlements don’t often work out in favor of the Defendant. To reinstate your agency as an e-commerce operator and/or to address the allegations, the best way to do so is with Stockman & Poropat, PLLC at your side!
Understanding the Allegations Made Against E-Commerce Sellers
To illuminate further details about the LFC trademark infringement action, we’ll share a few excerpts below:
The success of the LFC brand has resulted in significant counterfeiting of the LFC Trademarks. In recent years, Plaintiff has identified many fully interactive, e-commerce stores offering Counterfeit Products on online marketplace platforms such as Amazon, Temu, and PayPal, including the e-commerce stores operating under the Seller Aliases.
E-commerce stores operating under the Seller Aliases appear sophisticated and accept payment in U.S. dollars and/or funds from U.S. bank accounts via credit cards, Alipay, Amazon Pay, and/or PayPal. E-commerce stores operating under the Seller Aliases often include content and images that make it very difficult for consumers to distinguish such stores from an authorized retailer. Plaintiff has not licensed or authorized Defendants to use any of the LFC Trademarks, and none of the Defendants are authorized retailers of genuine LFC Products.
Other e-commerce stores operating under Seller Aliases omit using the LFC Trademarks in the item title to evade enforcement efforts while using strategic item titles and descriptions that will trigger their listings when consumers are searching for LFC Products.
