PAW Patrol Lawsuit Against E-Commerce Sellers

PAW Patrol Trademark and Copyright Infringement Claims. Spin Master LTD. and Spin Master, Inc. have filed a lawsuit, claiming e-commerce sellers have engaged in trademark and copyright infringement. Case No. 23-cv-02781 was filed by the firm Greer, Burns & Crain, Ltd.

According to PAW Patrol, the brand has been damaged by online retailers offering infringing products to consumers in the US. As a Defendant, the company claims you have sold unauthorized PAW Patrol goods on various marketplaces. These platforms include AliExpress, Walmart, Wish.com, Amazon, eBay, DHgate, Etsy, and others.

It stands to reason, the most difficult aspect of the PAW Patrol lawsuit is the Temporary Restraining Order (TRO). The TRO essentially halts your right to sell PAW Patrol goods. Also, it may hinder your ability to collect any money earned through the previous sale of those goods. In addition, the TRO could prohibit you from accessing money related to other products sold. Even if they have nothing to do with PAW Patrol. To a degree, the TRO can be a bit of a headache.

Details of the lawsuit: 

The verification processes on the e-commerce platforms used to sell PAW Patrol products are inadequate, per the lawsuit. This inadequacy allegedly permits “counterfeiters to ‘routinely use false or inaccurate names and addresses when registering with these e-commerce platforms.’” As an extension of the platforms’ verification failures, an opportunity has arisen for sellers with intent to counterfeit. 

The lawsuit says you and the other Defendants knowingly abuse the insufficient identification practices on e-commerce platforms to maintain your anonymity and continue fooling consumers into buying fake goods. PAW Patrol also states that you and the other named sellers are working together to actively commit these illegal acts. By communicating on sites like QQ.com, sellerdefense.cn, kaidianyo.com, and kuajingvs.com, you allegedly develop best fraudulent practices as a network of counterfeiters. 

By virtue of off-shore bank accounts, you also “regularly move funds from [] financial accounts to off-shore accounts outside the jurisdiction of this Court to avoid payment of any monetary judgment awarded to Spin Master.” This claim is based on a review of previous cases that have some similarity to this one, says the trademark and copyright owner. All in all, the claim against you is that you are consciously and in an unauthorized manner advertising and selling infringing PAW Patrol toys and products.
