Amazon Arbitration & Withheld Funds Recovery

Amazon is holding your money and Seller Support has stopped giving you answers. The account may be closed, the appeal may have gone nowhere, and the balance sits in the account with no disbursement date. Sellers in this position often wait months on the assumption that the funds release automatically. Frequently they do not.

The Business Solutions Agreement is a contract, and it contains a dispute resolution provision. That provision is the leverage. A properly framed demand, followed where necessary by an arbitration filing, moves a matter that Seller Central had been ignoring, because the filing puts it in front of Amazon's legal team rather than an automated queue.

Why funds stay held

Some holds are ordinary. Amazon applies a rolling reserve to newer accounts and holds disbursements during an active investigation. Those typically resolve on their own. The problematic holds are the ones that follow a deactivation, where the reserve becomes indefinite and no one at Amazon owns the decision to release it.

Account closure creates its own set of problems. Funds may remain after the account is closed, FBA inventory may still be in fulfillment centers, and reimbursement claims for lost or damaged units may never have been credited. Each of those is a separate demand, and sellers routinely pursue the balance while forgetting the inventory.

Chargebacks, A-to-z reimbursements, and long-tail fee reconciliations can also leave real money on the table that a simple balance figure does not show.

The demand-then-arbitration sequence

The first step is a written demand that identifies the contractual basis, quantifies the amount with supporting reports, and sets a deadline. A meaningful share of matters resolve at this stage, because a documented demand from counsel routes differently inside Amazon than a support ticket.

If it does not resolve, the next step is a formal arbitration demand under the agreement's dispute provision. That involves filing with the designated arbitration provider, paying the applicable fees, and serving Amazon's designated agent. Amazon responds, and matters are frequently resolved before a hearing occurs.

Timelines vary considerably depending on the provider's docket, the amount in controversy, and Amazon's posture. No one can promise a date, but the process typically progresses far faster than continued appeals through Seller Central.

How long can Amazon hold my money after deactivation?
Amazon's policies reference holds tied to investigations and to the return window, commonly discussed as a 90-day period, but in practice reserves after a deactivation can persist far longer without a stated end date. A hold that continues well past the ordinary window with no explanation is generally the point at which a formal demand becomes appropriate.
Is arbitration against Amazon worth it for a small balance?
Not always. Filing fees, attorney time, and the effort of assembling records all factor in, and for small balances a well-documented demand letter is often the better economic choice. We give a candid assessment before anything is filed, because a recovery that costs more than it returns is not a recovery.
Do I have to arbitrate, or can I sue Amazon in court?
The Business Solutions Agreement generally directs disputes to arbitration, and Amazon typically enforces that provision. Whether an exception applies depends on the claim and the version of the agreement in effect. Small claims court is a limited alternative in some circumstances, though the recoverable amount is capped.
What happens to my FBA inventory if my account is closed?
Inventory in fulfillment centers does not release itself. Sellers generally must submit removal orders, and inventory can be marked stranded or ultimately disposed of when no action is taken. Recovering or being reimbursed for that inventory is a separate claim from the account balance, and it should be pursued alongside it.
Will filing arbitration hurt my chances of reinstatement?
The two processes are handled by different parts of Amazon, and filing does not automatically foreclose an appeal. Sequencing still matters, because in some matters it is better to exhaust a viable appeal first. We assess where the appeal realistically stands before recommending that anything be filed.
What documents do I need to start a funds recovery matter?
