Amazon Seller Attorney for California Sellers
Suspensions, intellectual property disputes, lawsuits, and held funds. Counsel for your next step, based in Lynbrook, New York.
Discuss your Amazon matterCalifornia is home to a large share of the businesses that sell on Amazon, from private-label brands in Los Angeles and Orange County to importers working through the ports of Long Beach and Oakland and technology-driven sellers in the Bay Area and San Diego. When an account is deactivated, a listing is removed after a rights-owner complaint, or a balance is suddenly held, the effect on inventory, advertising, and payroll is immediate. The first task is to understand exactly which problem you are facing and what the record shows.
Stockman & Poropat, PLLC represents Amazon sellers across the country, including businesses based in California. Our office is in Lynbrook, New York; we do not have a California office. Much of an Amazon dispute is governed by Amazon's Business Solutions Agreement, Amazon's own policies, and federal intellectual property law, which is why we can handle appeals, complaint responses, arbitration, and IP matters for California sellers through remote consultations, phone, and video.

Identify the problem before responding
An account-wide deactivation, a single ASIN suppression, and a payment hold may all look like a suspension from the seller's dashboard, but they call for different responses. Keep the complete notice, the policy cited, the affected listings, and every message exchanged with Seller Performance. A short summary rarely captures the details a later reviewer will rely on.
Sellers who import through California ports often depend on overseas manufacturers, freight forwarders, and third-party logistics providers. Before responding to an authenticity or safety concern, confirm which entity appears on the invoices, whether the documents match the listing, and who controls the brand and product content. Inconsistencies between those records are a common reason appeals fail. Never alter or recreate documents to fit an appeal.
Intellectual property complaints against California brands
Trademark, copyright, and patent complaints can remove listings even when a seller believes the goods are genuine or the content is original. A useful response starts with the right being asserted, the specific products or images named, and the complainant's contact information. Licenses, supplier authorizations, original photography files, and design records may each be relevant, depending on what is actually alleged.
Many California sellers also run their own storefronts and social channels. If the challenged image or product name appears outside Amazon, review those uses as well, because a rights owner may raise the same concern elsewhere. Our intellectual property practice can also help sellers protect their own brands through trademark registration, which strengthens their position when competitors hijack listings or file complaints.
Federal lawsuits and frozen balances
If a payment hold refers to a case number, a plaintiff, a temporary restraining order, or a Schedule A, the freeze likely comes from a court order rather than an Amazon policy review. These cases are frequently filed in federal courts outside California, and the deadlines are set by the court. A Seller Central appeal does not answer a lawsuit, so preserve the complaint, the orders, and any settlement correspondence and get legal review promptly.
We evaluate court representation case by case and associate local counsel where a particular court requires it. Early review matters because options such as contesting the scope of an asset freeze may narrow quickly once a preliminary injunction is entered.
Withheld funds and arbitration
For a funds dispute, separate the balance displayed in Seller Central from the amount actually eligible for disbursement. Save settlement reports, transaction history, and every request for release. A clear chronology shows whether the hold is tied to an open investigation, a policy concern, or litigation, which affects what can realistically be done.
Arbitration under the Business Solutions Agreement can be an option in some cases, but it is not a shortcut and it involves cost. We review the agreement, the evidence, and the amount at stake before recommending whether to negotiate, arbitrate, or wait. No attorney can guarantee the release of withheld money.
Preparing for a consultation
Gather the original notices, a short timeline, the account's legal entity details, key supplier documents, and copies of earlier appeals. If you have been sued, include the complaint and every court order. Be clear about the outcome you need most: account access, listing restoration, release of funds, or a defense strategy.
Consultations for California sellers are held remotely, and we can discuss scope and fees before you decide how to proceed. General information on this page is not legal advice about your account or case.
