Amazon Seller Attorney for Illinois & Schedule A Cases

Suspensions, intellectual property disputes, lawsuits, and held funds. Counsel for your next step, based in Lynbrook, New York.

Discuss your Amazon matter

Illinois matters to Amazon sellers for two reasons. Chicago and its suburbs are home to many marketplace businesses, distributors, and logistics operations, and the federal court in Chicago, the U.S. District Court for the Northern District of Illinois, has become one of the most common venues for Schedule A lawsuits, in which brand owners sue large numbers of online sellers in a single case and ask the court to freeze their marketplace accounts.

Stockman & Poropat, PLLC represents Amazon sellers nationwide, including businesses in Illinois and sellers anywhere who have been named in Illinois Schedule A cases. Our office is in Lynbrook, New York; we do not have an Illinois office. We evaluate court representation case by case and associate local counsel where the court's rules require it.

If you have been named in a Schedule A lawsuit

Sellers often learn about a Schedule A case when funds are suddenly frozen or Amazon forwards notice of a court order. The complaint usually lists defendants by store name in a separate schedule rather than in the body of the complaint. Find the case number, the plaintiff, the trademark or copyright at issue, and every order entered, including any temporary restraining order or preliminary injunction.

Deadlines in these cases run quickly. Ignoring the case can lead to a default judgment, and paying a settlement demand without reviewing the claim can mean paying more than the dispute warrants. Options can include challenging the scope of an asset freeze, negotiating a resolution, or defending on the merits, depending on the evidence. Our guide to Schedule A lawsuits explains the process in more detail.

Account suspensions for Illinois sellers

An account-wide deactivation, a removed listing, and a payment hold each call for a different response. Keep the full notice, the policy referenced, the affected ASINs, and all messages with Amazon. Review earlier appeals before submitting anything new so the account history stays consistent.

Businesses that distribute through Midwest warehouses or third-party logistics providers should confirm which entity appears on invoices and whether supplier documentation matches the listings. Mismatched records are a common reason authenticity appeals are rejected. Do not create or alter documents to support an appeal.

Responding to intellectual property complaints

Trademark, copyright, and patent complaints can remove listings even when the seller believes the goods are genuine. Start with the right being asserted and the specific products named. Licenses, supplier authorizations, and original content records may be relevant depending on the allegation, and in some cases communicating directly with the rights owner leads to a retraction.

A platform complaint and a federal lawsuit are different procedures with different consequences. A rights owner can do both, so sellers who receive repeated complaints from the same brand should review their exposure before the matter reaches court.

Frozen funds and arbitration

When a balance is held, determine whether the hold comes from a court order or from Amazon's own review. A court-ordered freeze is governed by the order itself and can only be changed through the court. A policy-based hold may be addressed through Amazon or, in some cases, arbitration under the Business Solutions Agreement.

Save settlement reports, transaction history, and requests for release. We review the agreement, the evidence, and the amount at stake before recommending a path, and no attorney can guarantee that withheld money will be released.

Preparing for a consultation

Bring the notices, any complaint and court orders, a short timeline, the account's legal entity details, supplier documents, and copies of earlier appeals. Note the dates stated in any order, since they may control what can be done next.

Consultations for Illinois sellers are held remotely by phone or video. We can discuss scope and fees before you decide how to proceed. General information on this page is not legal advice about your account or case.

Illinois seller questions

Why are so many Schedule A cases filed in Illinois?
Brand owners frequently file these cases in the Northern District of Illinois in Chicago. Being named there does not mean your business is located in Illinois; sellers from many states and countries appear on these schedules.
Do you have an office in Illinois?
No. Our office is at 40 Broadway, Suite 201, Lynbrook, NY 11563. We review each case individually and associate local counsel where the court requires it.
Should I accept the plaintiff's settlement offer?
Not before the complaint, the evidence against your listings, and the amount frozen have been reviewed. A settlement may be appropriate, but its terms should reflect the actual claim.
